SPECIAL PROVISIONS

Tom Hurley, Barrister

The standard powers and procedures of the AAT and VCAT are as described above. However, in relation to each Tribunal's respective jurisdictions, their powers and procedures are modified by special provisions in the relevant Acts or Regulations. For example, there are special provisions (and sometimes special forms) relating to the hearing by VCAT of state taxation cases, planning cases and certain other types of case. The particular legislation under which the Tribunal is operating must be checked in each case.
