Commonwealth legislation sets out minimum standards for goods and services.
From 1 January 2011, the TPA was renamed the Competition and Consumer Act 2010 ("C&CA") and a new uniform national regime of minimum standards are in place, as part of the new Australian Consumer Law (ACL). The ACL is set out as Schedule 2 to the C&CA. It commenced fully on 1 January 2011; however, unfair contract term provisions came into effect both in the Commonwealth and Victoria on 1 July 2010 (see: Chapter 12*3 Consumer Protection Legislation for further information).
The ACL now provides a number of consumer guarantees in relation to the supply of goods and services. Where there has been a breach of a consumer guarantee, the guarantee will be enforceable as an independent right.
