NEGOTIATION

Is there any possibility that negotiation would settle the issue without the need for a formal hearing? Most forums, including the Magistrates' Courts, the Family Court and the Equal Opportunity List of VCAT, provide time for preliminary negotiations to take place between the parties before they attend a formal hearing. Often, if you approach the opposing party with a firm proposal to settle the matter, both parties will be encouraged to compromise and settle to avoid spending further time, effort and money.

If you have a number of charges, the wisest course is to get advice before the day of the hearing, even where you will be representing yourself at court. It may be that a lawyer is willing to conduct negotiations on your behalf. Always ask your lawyer about the extent of the help available to you, and if you are told that you cannot obtain any further assistance, request a referral to an alternate service that could help you further or advice about what to do next.
